Nexcall Solution provides pay-per-call lead generation services connecting businesses (Advertisers) with potential customers through inbound phone calls. Our services include:

• Inbound call services and live call transfers
• Outbound call services
• Insurance lead generation (auto, health, home, Medicare, final expense)
• Home services lead generation
• Publisher monetization programs

3. Advertiser Terms

As an Advertiser using our platform, you agree to:

• Provide accurate and complete information about your business and services
• Pay for all qualified calls as defined in your campaign agreement
• Comply with all applicable laws and regulations, including TCPA
• Not use our leads for any unlawful or prohibited purpose
• Maintain appropriate licenses and registrations required for your industry
• Handle all personal data received through our platform in accordance with applicable privacy laws

4. Publisher Terms

As a Publisher in our network, you agree to:

• Only send genuine, high-intent calls to our platform
• Not engage in call fraud, traffic manipulation, or deceptive practices
• Comply with all applicable laws including TCPA and FTC regulations
• Obtain proper consent before generating calls through our network
• Not misrepresent the services or companies you are promoting

5. Payment Terms

Payment terms are established in individual campaign agreements. General terms include:

• Advertisers are billed only for calls meeting agreed-upon qualifying criteria
• Publishers receive payouts according to the agreed schedule and rates
• Nexcall Solution reserves the right to withhold payment for fraudulent or invalid calls
• Disputes must be raised within 7 business days of the billing period
• All payments are in US Dollars unless otherwise agreed

6. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Generating fake or fraudulent calls
• Violating any applicable laws or regulations
• Infringing on intellectual property rights of Nexcall Solution or any third party
• Attempting to gain unauthorized access to our systems
• Using our services to harass, abuse, or harm others
• Reverse engineering or copying our platform or technology

7. Intellectual Property

All content, trademarks, logos, and other intellectual property on this website are the property of Nexcall Solution or its licensors. You may not use, reproduce, or distribute any content from our website without our express written permission.

8. Limitation of Liability

To the maximum extent permitted by law, Nexcall Solution shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of, or inability to use, our services. Our total liability shall not exceed the amount paid by you to us in the three months preceding the claim.

9. Disclaimer of Warranties

Our services are provided "as is" without any warranties of any kind, either express or implied. We do not warrant that our services will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Indemnification

You agree to indemnify and hold harmless Nexcall Solution and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of our services or violation of these Terms.

11. Termination

We reserve the right to suspend or terminate your access to our services at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in Dallas County, Texas.

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the "Last Updated" date. Your continued use of our services after changes constitutes acceptance of the new Terms.
